Tuning Terms of Service

RELEASE OF LIABILITY AGREEMENT

Scala Tuning – Engine Tuning Services

By selecting the I Agree box at checkout, the Customer acknowledges and agrees to the following terms and conditions regarding engine tuning services performed by Scala Tuning:

1. Assumption of Risk

The Customer understands that engine tuning, ECU recalibration, performance modifications, and related services involve inherent risks. These risks may include, but are not limited to: engine damage, drivetrain failure, component wear, reduced engine lifespan, overheating, mechanical failure, or total engine failure. The Customer voluntarily assumes all risks associated with such modifications.

2. No Warranty on Modified Vehicles

The Customer acknowledges that any modification performed by Scala Tuning may void manufacturer warranties. Scala Tuning makes no representations or guarantees regarding the continued validity of any manufacturer or third-party warranty.

3. Release and Waiver of Liability

To the fullest extent permitted by law, the Customer hereby releases, waives, and discharges Scala Tuning, its owners, employees, contractors, affiliates, and agents from any and all liability, claims, demands, damages, losses, costs, or causes of action arising out of or related to:

  • Mechanical failure or damage to the vehicle or its components

  • Loss of vehicle use

  • Personal injury or property damage

  • Towing, repair, or replacement costs

  • Consequential or incidental damages

  • Any issue arising from performance modifications

This release applies whether such claims arise from negligence (except gross negligence or willful misconduct, where prohibited by law) or otherwise.

4. Off-Road / Competition Use Acknowledgment

The Customer understands that certain tuning services may be intended for off-road or competition use only and may not comply with local, state, or federal emissions or road-use regulations. The Customer accepts full responsibility for ensuring the vehicle complies with applicable laws and regulations.

5. Vehicle Condition Representation

The Customer represents that the vehicle is in sound mechanical condition prior to tuning and discloses any known mechanical issues. Scala Tuning is not responsible for pre-existing conditions or failures resulting from such conditions.

6. Indemnification

The Customer agrees to indemnify and hold harmless Scala Tuning from any third-party claims arising from the use, operation, or resale of the modified vehicle.

7. Acknowledgment and Consent

By Clicking "I Agree" and purchasing the service/product, the Customer confirms that they have read, understood, and voluntarily agree to this Release of Liability Agreement.
